The Bengal Chamber of Commerce and Industry organized a Webinar on "Analysis of the Law of Frustration of Contract or Force Majeure in the Pandemic situation of COVID-19" on Saturday, 6th June 2020, 11 a.m. to 12:30 p.m., under the leadership of Mr D N Mitra, Chairperson, Legal Committee of The Bengal Chamber.
The Webinar was moderated by Mr. Samrat Sen, Senior Advocate, High Court at Calcutta, focused the discussion on Doctrine of Frustration and the Doctrine of Force Majeure and its applicability on the contracts during the Pandemic Period.
The discussion started Mr. Surendra Kumar Kapur, Barrister at Law & Senior Advocate, High Court at Calcutta. Mr Kapur focused on the Law of Frustration, its principles and the applicability. The discussion was then taken over by Mr. Justice Sanjib Banerjee, Judge, High Court at Calcutta who spoke on the concept of Force Majeure, the development of on the Law of Force Majeure and the current status. He said that the intention of the performance and the act of impossibility in its performance needs to be identified. Mr. Jaideep Gupta, Senior Advocate, Supreme Court of India focused on the legal framework, several legislations, orders, guidelines issued by the Government under the Disaster Management Act in the background of Laws of Frustration and Force Majeure.
The Session concluded by a Valedictory note by the Chairman of the Legal Committee Mr D.N. Mitra.
